Terms of Service

ThroughTheirEyes.ai ("the Service") is operated by I4HUM LIMITED, a New Zealand–registered company ("we", "us", "our"). By accessing or using the Service, you ("you", "the user") agree to these Terms.

If you do not agree, you must not use the Service.

1. About the Service

ThroughTheirEyes.ai allows users to upload genealogical data (GEDCOM files) and generate AI-powered ancestral personas using historical records, structured blueprints, contextual information, and conversational inference.

The Service is designed to:

  • protect living individuals,
  • support historically grounded experiences,
  • provide transparent provenance cues,
  • and enable ethical use of AI.

A synthetic, fictional demo persona ("William Price") is provided for safe evaluation.

2. Eligibility

To use this Service:

  • You must be 18 years or older.
  • You agree not to use the Service for unlawful or harmful purposes.
  • You understand that most GEDCOM files include living individuals by default; our system automatically removes such records during processing. You do not need to modify your file before upload.

The Service is not intended for minors.

3. User Accounts & Authentication

Authentication is managed by Clerk, a third-party identity provider.

  • Your email, credentials, and authentication data remain within Clerk's systems.
  • We receive only pseudonymous identifiers (workspace ID and user ID). These cannot identify you directly and can be linked to your Clerk account only through Clerk’s secure identity system. We cannot reidentify you without Clerk.
  • By using the Service, you agree to Clerk's terms and policies.

No identifying information (e.g., email, name) is stored inside the TTE backend platform.

4. Acceptable Use

You must not:

  • upload content intended to preserve identifiable information about living individuals,
  • attempt to re-identify living persons using inferred or historical data,
  • use the Service to generate harmful, abusive, or harassing content,
  • interfere with or reverse-engineer the platform, prompts, or AI behavior,
  • attempt to access data belonging to other users or workspaces.

We may suspend or terminate access for violations.

5. Uploaded Genealogical Data

5.1 Living Person Removal

The system automatically:

  • removes individuals with no death date and a birth within the last 110 years,
  • removes records explicitly marked as "living,"
  • rejects files that cannot be safely cleaned.
  • strips all NOTE tags and associated free-text notes, regardless of whether individuals are living or deceased.

This safeguard is mandatory and automatic.

Additional Eligibility Safeguards: During persona selection, the Service applies further rules to prevent the recreation of individuals who may still have emotional significance to living relatives. Individuals who died within the last 50 years cannot be selected as personas. Those who died between 50 and 75 years ago remain visible but carry a caution notice to help users make informed, respectful choices.

5.2 Storage Architecture

Only the cleaned, privacy-safe version of your GEDCOM file is ever stored.

Uploaded GEDCOM files are:

  • encrypted at rest using quarterly rotated encryption keys,
  • stored in Cloudflare R2 in a tenancy-isolated structure,
  • decrypted only at runtime to generate personas,
  • deleted on request or when your account is removed.
  • deleted data may persist in encrypted backups for up to 30 days before complete removal.

We never use your GEDCOM data to train AI models.

5.3 User Responsibility for Uploaded Data

By uploading a GEDCOM file or any genealogical material, you confirm that you have the legal right to provide this data to the Service. GEDCOM files often include information about living individuals, including yourself and close relatives.

The Service processes the uploaded file only in memory and automatically removes living individuals before long-term storage to protect privacy. However, you remain responsible for ensuring that any data you upload complies with applicable privacy laws, family expectations, or other obligations.

If you do not have rights to share specific genealogical materials, you must not upload them to the Service.

Because persona eligibility includes safeguards based on death dates, some deceased individuals in your GEDCOM file may be visible in your family tree but not selectable as personas. This ensures compliance with our ethical guidelines without altering the historical structure of your genealogical data.

6. AI Models & Inference

We use direct API access (not aggregators) to:

  • OpenAI
  • Anthropic

We do not send genealogical conversations to providers located in jurisdictions with insufficient data protection guarantees.

6.1 No Model Training or Retention

Your data is never used to train or fine-tune third-party AI models.

We explicitly enforce each provider's "no training / no retention" settings where supported.

7. Conversational Data

Conversation content is:

  • encrypted in transit (HTTPS),
  • encrypted at rest using rotating keys,
  • associated only with your pseudonymous workspace ID,
  • not readable by platform operators except through transient, automated safety filters.

Automated safety filters operate on ephemeral (non-persistent) representations and do not log or store message content.

You may delete conversation history at any time.

Demo conversations are not linked to an account unless you explicitly submit them.

8. Optional Memory System (Disabled in Demo)

The backend includes an encrypted graph-based memory engine capable of:

  • storing episodic conversational data,
  • tracking validated place names,
  • linking associative memory for continuity.

This system is:

  • off by default,
  • opt-in only when released,
  • encrypted at rest,
  • isolated per workspace,
  • never used to store unencrypted personal data.

No memory graph data is used for model training.

9. Intellectual Property

9.1 User Content

You retain ownership of:

  • your uploaded GEDCOM files,
  • notes and contextual information you provide,
  • any genealogical metadata you contribute.

You grant us a limited license to process this data solely to provide the Service.

9.2 Generated Content

AI-generated personas and conversations are provided for personal, non-commercial use.

Commercial use requires our prior written approval.

10. Beta Access & Changes

The Service is currently in beta. As such:

  • features may change or be removed,
  • outages or downtime may occur,
  • data persistence cannot be guaranteed,
  • some features (e.g., memory) are experimental.

We may modify or discontinue parts of the Service at any time.

We use a waitlist to manage beta demand and protect service performance, privacy guarantees, and operational costs.

11. Fees & Billing

  • The beta period is free.
  • Post-beta pricing is to be determined and may involve subscription tiers or usage-based billing.
  • You will be informed before any paid plans are activated.
  • Payments, when introduced, will be handled through Clerk + Stripe.

12. Termination

We may suspend or terminate access if:

  • you violate these Terms,
  • you misuse genealogical or inferred data,
  • you circumvent safety systems,
  • you behave abusively toward staff or the platform.

You may delete your account at any time via Clerk.

Account deletion through Clerk will also trigger deletion of associated personas, GEDCOM files, and conversation history, which may persist in encrypted backups for up to 30 days.

13. Disclaimers

The Service is provided "as is" without warranties of any kind.

We do not guarantee:

  • historical accuracy,
  • genealogical completeness,
  • emotional outcomes,
  • uninterrupted access,
  • perfect model behavior.

AI-generated ancestral personas may include “historical inference”: contextual details drawn from general knowledge about the period, location, or occupation. These inferences enhance narrative authenticity but should not be treated as verified genealogical fact unless explicitly supported by your GEDCOM file or marked with a provenance citation.

14. Limitation of Liability

To the maximum extent permitted by New Zealand law:

  • we are not liable for indirect, incidental, or consequential damages;
  • total liability is limited to the greater of NZD $50 or the amount paid by you in the prior 3 months.

15. Governing Law

These Terms are governed by the laws of New Zealand.

Any disputes will be handled in New Zealand courts.
